Is ECU tuning legal on a street vehicle in the U.S.?

The EPA Clean Air Act is the controlling authority on whether you can alter the ECU

ECU tuning, or modifying the software in the ECU to obtain better performance, is considered tampering, and is illegal throughout the U.S. Any modification to the ECU that changes the way the engine burns fuel and affects emissions, is illegal.

The altered VW Diesel engines passed smog too, but they were still illegal. The smog test only tests the vehicle under certain conditions. So it’s possible to ECU tune your car so it passes smog, but pollutes heavily outside of the test parameters.
